Although individuals going through divorce or a paternity case do all they can to plan and be prepared for the “what if’s” down the road, sometimes life gets in the way, and they find themselves with a Decree and parenting plan that just doesn’t work anymore. When this happens, all is not lost! Your decree and parenting plan just need to be adjusted to work with your new circumstances.
The hardest part of having your decree modified will be coming to a full agreement about the changes to be made before filing with the court. (To avoid getting “stuck” in the court system, we cannot stress enough the importance of having a full agreement in place before filing!) The changes needing to be made are usually significant, and parties often have trouble coming to an agreement on their own. Whether it’s a new parenting plan, adjusted child support, or relocation, getting help from a court-approved domestic mediator will be key in working through these issues successfully and peacefully.
While your new agreement serves as the basis for your new Decree, it is NOT your new Decree and is NOT legally binding. As with Divorce and Paternity cases, individuals who use a traditional mediation service leave with their agreement, but are on their own to either hire an expensive attorney to draft papers for them (which adds considerable time and cost), or to go the court process on their own and draft their own papers.
